Description of the Dilemma: The Bank of the United States is a powerful institution. It holds the federal government's money and controls much of the country's money supply. Although it is on a contract chartered by Congress, it is run by private bankers who President Jackson feels is an organization of wealthy North easterners that ignore the needs of the "common people."
Jackson wants to kill the bank. The bank is not representative of Jacksonian Democracy, which is government for the "common man." He believes that it is an institution for the rich and powerful, which he thinks is unconstitutional. The banks president, Nicholas Biddle, also represented everything that Jackson didn't like. Jackson thought of himself as common man who raised himself up from nothing . Biddle, on the other hand, came from a wealthy family. Jackson shared his feelings about the bank with his VP saying, "the bank is trying to kill me. But I will kill it." It's 1832, Henry Clay and Daniel Webster persuaded Biddle to apply for a new charter for the bank, even though the current charter does not expire until 1836.
Senators Henry Clay and Daniel Webster believe that the National Bank has popular support and wants to use it against Jackson during the election of 1832 so Clay can win the presidency. Clay feel that if Jackson vetoes a re-charter of the National Bank, it would make Jackson look bad and allow Clay to be elected president. The Supreme Court also decided in McCullough vs. Maryland that the National Bank was constitutional and should stay.
