Language of the Discipline to Define: Cherokee, treaties, relocate, "five civilized tribes", Dilemma Description: Through treaties with the United States government in previous years, the Cherokee Indian Tribe was recognized as a separate nation within the state of Georgia. However, gold has been discovered in the Cherokee nation. American settlers have begun trespassing on Cherokee land in the pursuit of riches. The state of Georgia doesn't recognize the Cherokee as it's own nation and wants the U.S. government to relocate them out west to an Indian Territory (present day Oklahoma). Congress passed the Indian Removal Act in 1830 to move the Cherokee (and other tribes) to the Indian Territory. The act also stated that the federal government would pay the Native Americans for their land. However, the Cherokees refused to give up their land. The Cherokees argued that they have lived on the land far longer than the trespassers. They are members of the "Five Civilized Tribes", and have even established their own newspapers, constitution, schools, and alphabet. The Supreme Court sided with their argument in the 1832 case, "Worcester v. Georgia." Chief Justice John Marshall declared that Georgia had no right to take Cherokee land. This declaration will not stop settlers from going into Cherokee land to look for gold. So what should President Andrew Jackson do to resolve this situation? |
